- OWNERSHIP AND GENERAL RULES
1.0 - Ownership is effective only after the payment (and money/goods transaction) has been completed.
1.1 - All designs/art made by me, must be linked back in some way, shape, or form. If someone asks who the artist is, you must tell them I made the art/design.
1.2 - Crediting me (alexia99hunter) as the design creator is obligatory.
1.3 - Under no circumstances you're allowed to apply your own rules on one of my designs. This means that rules and duties such as "the characters must only come back to me in case of selling", "do not sell to this specific person", "do not change gender or story" do not exist. Please, be aware of sellers and users who ask said things: if a design is made by me, my rules apply.
1.4 - do not steal, fully or partially copy, recolor, clone, or heavily reference any of my designs.
1.5 - If I'm doing a NSFW(18+) ych/commission, you as a buyer, must tell me you are of age to receive said art. If at any time I doubt you are of age I will make a beware/blacklist/block you.
1.6 - If a design/art you've received is not to your liking, you are to first tell me before selling/trading them away. If I find they were given away without my permission I have full rights to take the character back, and put you under my blacklist.
1.7 - When doing commissions I will wait until the sketch has been approved, and a finished version has been shown to the buyer before wanting payment. YCH's are a pay first, since they have quicker turnaround times, and the buyer has already seen a sketch of the to-be art. If the buyer pays and the art isn't done within 2 months a refund can be issued, unless the buyer still wants the art. (Please keep in mind I do have a life and job, as well as three animals & husband to work/live with, so life can be busy.)
- EDITING AND TWEAKS
2.1 - Any edit to my designs is fine (be it gender, name, colors, markings, clothing, age, backstory) as long as the design is still recognizable. Even after edits are made, character must still be credited to me as the original designer. In case of a re-design, you're allowed to credit me as the previous design's creator and yourself/another artist as the new design's creator. Do not draw/edit my art itself, unless my permission was given (to you).
2.2 - You are not allowed to clone, breed or create twins of my designs (unless they're sold all together to the same user).
- SELLING AND TRADING
3.1 - A character can not be sold/traded/exchanged for more than its worth. The "worth" includes the price the character was previously obtained for, self made art, commissioned art, or art obtained via art trade or whatever item you paid; the worth does not includes gift art or fan art, as you did not pay for them and may not profit off another person's work.
By no circumstances* (see 3.4) i allow one of my designs to be sold or traded for more than its worth.
If getting caught selling a character for more than its worth or scamming, a (partial or total) refund must be given to the buyer.
3.2 - The previous rule applies to any form of payment and exchange, whether it's art, money, characters, material or virtual goods.
3.3 - There is no such thing as "sentimental value": the time and the meaning the character has for you adds nothing to the price.
3.4 - Under "offer to adopt" circumstances the seller may sell the character to whatever price the buyer is offering to pay. This only applies if the buyer willingly offers the seller said amount money/goods (art, characters, virtual payments, and any other goods), and is aware of the real worth of the character. A price higher than the character's worth can not be forced by the seller, but someone can offer more than the character's value if they really want it and are bidding against another user (auction/offer to adopt cases).
3.5 - Do not harass design's owners to sell, trade or gift you any designs if they are not up for offers.
3.6 -When selling/trading a design, every art depicting the character must be linked or shown to the buyer: if some piece is missing or can't be found, it can't be included in the price. You can not make the new owner pay for your art you're not going to let them use or see.
- RULE BREAKING AND BLACKLIST
4.1 - Breaking any of the rules above will cause you to be blacklisted, meaning you will not be able to get any more designs by me from the blacklisting moment.
4.2 - Under no circumstances you're allowed to ask or beg to be removed from the blacklist. When getting messaged about the status, you are obviously allowed to discuss with me about the situation, providing proof of innocence if needed.
4.3 - If a blacklisted user is getting caught buying one of my designs after getting blacklisted, the character will be given back to the previous owner with or without refund depending on the situation. Every blacklisted user is directly tagged and privately messaged of being blacklisted and is well aware of their status: breaking rules again after knowing to not being able to obtain any of my designs makes them fully responsible of their actions.
4.4 - It is everyone's responsibility to be aware of the blacklisted users: if one's got caught by selling or giving a blacklisted user one of my designs, they will be messaged regarding the situation and the status of said person. If no action is taken on the situation, or if there is no will/desire to remedy, said user will be blacklisted as well for not respecting the blacklist.
4.5 - Getting blacklisted is my (alexia99hunter's) professional and personal choice; the purpose of the blacklist and of the Terms Of Service journal is to create a safe selling and trading community: if one individual is considered dangerous for it's personality or behavior to the artist's rights and content - such as having recent issues with ripping-off behaviors, thieves and breaking rules purposefully or repetively - they can be blacklisted as well.
