COMMISSIONER'S TERMS OF SERVICE

Terms of Service only apply to NON-COMMERCIAL use and work. 

Terms are subject to change at any time but will not be applied retroactively.

COMMISSIONERS WILL RECEIVE:

• List Sketch shown for approval before completion; commissioner may opt to keep this if they wish.
  High-resolution version of the commission, un-watermarked.
• List Commissioners WILL NOT receive a PSD, SAI, or any other file containing the layers of the work. I do not give these out. Commissioners will only receive the final flattened image, with or without a background as requested. The commissioner may opt to have a transparent background if they wish.

PAYMENT & REFUNDS

• List Example prices do not always apply. Commission prices can vary on complexity and detail included in the commission, as well as time taken on the piece. The "example" prices are simply meant to be a standard. Your price may be higher or lower than the given example price.
• List Payment upfront is required for Commissions.  Commissions will NOT be started without payment. If payment is not received within 1 week (or more depending on commission complexity) the commission will be cancelled.
• List Refunds will be given for incomplete commissions if asked. If any work has been completed, the refund will be minus the price of the work already done.
• List Refunds will not be given for finished commission work. It is the customer's responsibility to point out errors and changes in the commission. Once the commission is fully complete, work is non-refundable. 
• List Each commissioner receives TWO (2) FREE CHANGES to a piece. Changes are usually done during the sketch stage of the commission, which will be sent to the commissioner for revision. The THIRD (3rd) CHANGE and any further changes will result in a fee.
• List Paypal is the only acceptable form of payment. Send as a Purchase of Services, not Goods or a Gift. All payments must be made in USD (United States Dollars). E-cheques are not an acceptable form of payment.
• List I reserve the right to cancel any commission for any reason, at any given time. A refund will be given, minus any work already done if applicable.

COMMUNICATION:

• List E-mail is the best way to contact me and is the preferred method of communication.
• List Commissioners who are unresponsive for 1 MONTH (4 weeks) without any warning will be refunded minus work already completed.
• List If there are any delays, the commissioner will be notified appropriately. Larger projects/commissions may result in delays and the commissioner will be notified if any further delays happen.
• List Questions regarding commission updates are welcome, with a limit to twice a week. Continuous messages and/or harassment for updates will result in a cancellation of the commission with a refund minus work completed.
• List Rude or abusive commissioners will have their commissions INSTANTLY cancelled with a refund minus any work completed.

SUBJECT MATTER:

• List Know what you want before requesting a commission.
• List As a commissioner, communication is key.
• List Be clear and concise with what you want, and try to include every important detail before or during the sketch stage.
• List Quick fixes are welcome, however, the more information you have to offer, the more likely I am to include everything you want in your commission.
• List I will add simple design alterations to a commission if requested, but if design alterations are NOT minor, I will charge extra.
• List I will not draw in an art style other than my own unless I am offering a special sort of offer for a limited time. (Styles such as Disney, specific cartoon shows, another artist's, etc). You are commissioning me for my artwork, not somebody else's.
• List I will not draw anything over PG-13 content. I will also not draw hateful subjects of any kind. (Exceptions include artistic/tasteful nudity, pinups)
• List I will only draw copyrighted or trademarked content on a case-by-case basis.

RIGHTS & PERMISSIONS:

• List I retain FULL RIGHTS to the artwork unless the commissioner arranges to pay for the full rights. The commissioner DOES NOT have full rights to the artwork unless paid for and specifically stated by me, and me only. 
• List Private commissions for users who wish that the finish work not be posted online may be requested for an extra fee. Private commissions are not permitted to be posted on public websites by the commissioner. If I cannot post it, no one else can.
• List The commissioner is permitted to post the completed work to their PERSONAL gallery as long as the work is unedited and FULL credit is given to me.
• List The commissioner IS NOT permitted to make any physical edits/modifications to the artwork without my explicit permission. This includes, but is not limited to: Changing watermarks, recoloring, vectoring, tracing.
• List The commissioner IS NOT permitted to edit, sell prints, redistribute without permission, claim credit, or use for advertising in ANY fashion, profit or non-profit, unless previously agree upon and with an additional fee.
• List The commissioner is permitted to set the image as a wallpaper, an icon, or in a forum signature or for any other personal use. If the image is public, credit must be given visibly to me.
• List Sketches rejected from any commissioner may be recycled for later use.
• List Adoptables, custom or not, are permitted to be resold for ONLY the original price unless otherwise stated. Please contact me before reselling.

STREAMS:

• List Commissions can be streamed if requested by the commissioner at no extra charge. The commissioner and artist may work out a stream schedule and the commissioner can opt for the stream to be public or private. Private streams require no extra charge.
• List Commissioners are expected to point out errors and changes with their commission during the stream via the chat box. This is done best during the SKETCH stage. Failure to do so will result in a fee being charged for any changes when the commission is complete.
