This is my terms of service for anything I do, whether if they're general art pieces, adoptions, commissions, requests, kiribans, fan art, art trades, collaborations, gifts, or anything else!
Definitions
My Art - All art that is created by me, or has any portion of contribution from me.
Second Party - The party requesting the art piece.
Third Party - Anyone that comes across my art with no relation to it.
Censored - Blurred, pixelized, silhouetted, or distorted beyond recognition.
Checkpoint - A point at which art is shown for approval.
Profit - Any sort of profit greater than the purchased amount from me, in any currency. This applies to deviantart points, bitcoins, or any other medium of exchange. This includes any trade items.
General Terms apply to all services.
1) General Terms
i. Full Disclosure Rights
a. Artist Rights
I hold all rights to any art I create, unless agreed otherwise. I am free to display my art anywhere I choose.
b. Second & Third Party Rights
Third parties are permitted to share any of my art on any forum chosen as long as proper credit to me, the artist, is provided.
ii. Non Disclosure Rights
a. Agreement
All participating parties must agree to the disclosure rights exchange for it to take effect. I have the right as the artist to refuse.
b. Payment
If you do not want me to post a piece I have done for you somewhere, there is a $5/500pts non-disclosure fee. This cannot be refunded once paid.
c. Rights Exchanged
Once this fee is received, I will relinquish all rights to public display of the designated art piece. Should this be breached by the artist, the billing party has the right, only then, to demand a full refund. This does not apply to adoptions.
d. Artist Permissions
As the artist, I hold the right to have the original copy (likely the .sai/.psd file). I also hold the right to tell that I have created such an art piece with words or a share a heavily "censored" version of the art piece.
iii. Right to Decline
I, as the artist, am never obligated to do art for you. I always have the right to decline art you want me to create.
iv. Commercial Use
My art may never be used for profit unless given absolute permission from me.
v. Exclusion
I hold the right to prohibit anyone from any and all forms of service I provide.
vi. Wait Time
a. Progress
Though I may, I have no obligation to inform you of my progress on any art piece. I will give you a general idea of when I will finish, but I do not work with deadlines.
b. Work Order
There is no obligation in the order of me working either, except when the rush fee is paid. I am free to finish whichever art piece I desire regardless of payment or request time.
c. Rush Fee
Paying the designated rush fee (25%) would push you to the front of my completion line, behind all earlier received rush orders. This means that I literally drop everything and work on the designated art piece first, anyone can pay this fee, not just the second party. Rush orders apply to all services and are ordered according to the time of which the rush order fee was received. This in no way, indicates a deadline. It means that the designated piece receives priority, not a deadline.
vii. Artist Alterations
The second party has the right to request changes within 24 hours after an art piece completion, though I hold no obligation to make those changes. I also hold the right to alter my art in any way I choose, whenever I choose.
viii. Payment
Payment is accepted in both deviantart points and paypal. Conversion between points and paypal may vary, as determined by me.
ix. Delivery
This applies only to traditional art or anything that requires postage via snail mail. I am not to be held responsible for any incidents pertaining to it. I will not be held liable if you never receive what you have paid for, and you will not receive a refund. You will not receive any reimbursements or refund for any damages to your order either.
x. Retraction
Should any of these terms be breached, I hold the right to retract any relation you have to an art piece with no refund.
xi. Credit
a. General
No one may ever claim my art as their own. I am to always receive credit no matter where my art is displayed.
b. Printing & Tracing
Printing and tracing are not allowed.
c. Alterations
Watermarks are never allowed to be altered or removed by anyone other than me, the artist. The art itself may not be altered or censored in any way without my absolute consent. This also applies to original species, they may not be altered under any circumstance without my clear permission.
2) Requests, Rewards & Kiribans
i. Refusal
I have the right to refuse any request, reward, or kiriban without explanation.
3) Art Trades
i. Agreement
Art trades are only viable if all artists agree to set conditions prior to drawing. Do not expect art from me because you have drawn me something on a whim.
ii. Exchange
All parties have the right to withhold the art piece until all artists are prepared for the exchange.
4) Adoptions & Customs
i. Rights
The adopted creature may not be sold for a high price than bought. It is only with an adoption that you maybe address to one of my designs as yours. This does not make the art piece yours, just the design which you have paid for the rights to. I still must be credited for its creation and during use.
ii. Refund Policy
Once payment is received, no refunds are possible. Customs follow the refund policy in the following section, "6) Commissions & Customs".
iii. Payment
Payment must be completed within 24 hours of a confirmed adoption for the adoption to be claimed. Otherwise, you surrender your right to the adoption.
iv. Auctions
Only bid what you have, and follow all individual adoption rules such as the starting bid, bid location, and the minimum increase.
v. Original Species
a. Artist Rights
I have the right to alter my original species art as I desire even if I do not have ownership.
b. Alterations
No alterations are permitted without my consent.
c. Ownership
The artist, me, is to be informed of all ownership exchanges.
5) Collaborations
i. Credit
All parties shall receive credit as to exactly what was contributed by each member respectively.
ii. Exchange (if applicable)
All parties have the right to withhold the art piece until all artists are prepared for an exchange.
iii. Rights
All parties involved share equal right to the art piece unless agreed by all parties otherwise.
6) Commissions & Customs
i. Refund Policy
a. Artist Rights
I hold the right to refund you as much as the full amount at any point, should I choose not to continue with the commission. If I feel, as an artist, that I have been taken advantage of, have had information withheld, etc., or am overwhelmed by circumstances beyond my control, I reserve the right to refuse to continue/complete the commission with no refund.
b. Second Party Rights
A full refund may only be requested 24 hours after payment. After that, you may not request a refund. I have no obligation to show you my incomplete work if you have received a refund.
ii. Checkpoints
Prior to payment, you may request checkpoints at two specific completion stages; sketch and flat color, if they apply. I may alter or redo at these points given your critique if I choose to, though I hold no obligation to do so. I have the right to refuse you this privilege. I have the right to request a payment fee. If I do choose to do an alteration or remake, it will occur a maximum of once at each designated stage.
iii. Disclosure
I have the right to disclose all information regarding a commission or custom order. This includes references.
