Terms & Conditions
1) All communications concerning a commission must be via email (rpalmerarts@gmail.com) or through ArtistsnClients private messaging. This is to ensure all information is consolidated, and minimize miscommunications.
2) Commissions are completed in stages, with the Client recieving a sketch before any finalization/cleanup work has begun. During the sketch phase, the Client may request up to 3 major changes to the work, and/or red-line the sketch for absolute clariety. Once the sketch phase has been finalized, however, no alterations may be requested to the piece.
3) Displayed base prices are subject to change according to the complexity, difficulty, size and medium of each individual piece. However, unless the piece is a painting / charged on an hourly rate, the price changes must be communicated to the Client before the work leaves the sketch phase.
4) In order to recieve the final high-res, non-watermarked file, the full price of the commission must be made by the Client.
5) Visual references, or a clear and consise description of the requested commission idea must be provided by the Client. (ANC CLIENTS: If you are requesting more work than typically involved in a slot, please PM me with the details ASAP.)
6) The Artist reserves the right to issue a refund and cancel a commission due to poor communication, rude or inappropriate behavior, or if the Client has requested services the Artist has listed as prohibited (please reference the provided list of prohibited subjects.)
7) The Artist retains the right to display all commissioned work on any personal website, gallery, or journal. The Client may request a reasonable delay in the public posting of this work in writing, which will be considered on a case by case basis.
8) The Artist retains all rights to the commissioned artwork, including the right to make prints and merchandise, unless otherwise agreed upon in writing by the Artist. Purchasing the rights to print and merchandise will greatly increase the price of the commission.
9) The Client retains all rights to their intellectual property including characters, storylines, or world settings. This does not allow them rights to the commissioned image (see articles 7 & 8.)
10) Outside of red lining sketches for the purpose of clarity during the commission, the Client may not alter the artwork itself unless agreed upon in writing by both the Client and Artist.
11) The Client may upload the artwork to their personal website or gallery, but must:
a) Retain the signature on the commissioned work.
b) Properly credit the artist in any text description. (A link would be welcome, but is not required.)
c) Display a low-res or water-marked image ONLY.
12) The Artist retains the right to recycle sketches and prepatory works that were rejected by the Commission for any other commissions or personal works.
13) The Client must read, understand, and agree to all the above terms before entering into an agreement with the Artist. By sending payment, the Client agrees to the above terms.
