Terms of Service
Payment
All payments shall be sent via PayPal, BuyMeACoffee, or Stripe. The agreed payment structure for the duration of this project is:
100% due up front
Violation of this payment structure will result in a Breach of Contract, thus forfeiting the completed or incomplete assets created by the artist, Darleena Canania. If services are not performed by the artist, Darleena Canania, then the client is entitled to a refund based on a percentage of services not completed.
Payments through Paypal, BuyMeACoffee, or Stripe.
All Darleena Canania’s prices will be in USD. If the client does not know what the currency conversion would be, Darleena Canania will help the client find out how much the client will be paying in the client’s country’s currency.
No completed artwork will be released to the client without prior collection of payment.
No refund if the commission has been completed.
No Crypto Currency shall be accepted as payment.
Commissioner and Artist’s Rights and Usage
The term artworks are defined as images deemed finished by the artist.
The client cannot use it for monetized videos, ads, promo art, merchandise, or anything that would be beneficial for the client to be able to make money off Darleena Canania’s work. The client must have some kind of legally binding contract for Darleena Canania to look at and see the client’s terms.

The client may not claim the artwork as their own.
The client may not make edits of Darleena Canania’s artwork.
The client may not utilize the artwork, nor any assets of the project, for NFT’s.
The client may not utilize the artwork, nor any assets of the project for artificial intelligence training.
The client must credit the artist, Darleena Canania, when sharing or displaying the artworks in any venue, including, but not limited to, social media websites and platforms.
The client may not publish the artworks without permission of the artist, Darleena Canania.
The client shall be given completed assets in .JPEG, or .PNG formats.
The artist, Darleena Canania retains the right to display any artwork created for promotional purposes.
The artist, Darleena Canania may publish artwork to social media and other internet platforms for promotional purposes.
The artist, Darleena Canania may not sell prints of any artwork without the consent of the client.
The artist, Darleena Canania retains the rights to the .PSD original files and artwork.
Terms of Service Violation
The client and the artist, Darleena Canania, agree to all terms within this terms of service. Any action taken, willingly or unknowingly, to violate the terms of this terms of service may result in a Terms of Service Violation. This Terms of Service shall become null and void if there is an unresolved dispute over the following items:
Failure to correctly provide payment for creative services.
Failure to credit artist when displaying artwork.
Fraudulently claiming artwork is the product of the client.
Violation of the payment of the project.
Violating the rights and usage.
Failure to communicate requests for alterations.
Excessive alterations to artwork.
Intolerable treatment towards the artist.
Requesting artwork that the artist is not comfortable creating. (i.e. nude, pornographic, or adult content)
Client’s continued dissatisfaction with the assets completed.
Failure to provide clients with completed assets.
