Terms of Service
Important:
This document may be changed without warning.
I have the right to decline any request at any time.
You are allowed to ask how your commission is going.
I may use the designs or commissions I have drawn initially in my portfolio or for personal promotion. I will not reclaim designs once the purchase has been made final, but the IP and art remains mine.
Do Not:
Copy, heavily reference, or steal my art or text layouts.
Manipulate, edit, trace or copy any artwork you have bought from me or that has been made by me.
Claim the artwork you have received (via gift, commission, etc.) as your own.
Purchase Information
Payment:
USD payments will only be accepted through PayPal.
You will be invoiced, please never send money directly to me via micro-transaction unless I ask.
If you fail to pay the invoice on time then the transaction will be cancelled and any holds you have on designs or commission slots will be cancelled.
It is your job to let me know that you have sent a payment. If you fail to let me know that you attempted to send payment before the 24 hour (or 72 hour) hold is up, then you can not use the excuse to try and reclaim a design or commission slot.
Auction:
Serious bids/offers only - retracting a bid/offer and hiding comments is a bannable offense that can prohibit you from making future purchases.
Art offers are prohibited and will be overlooked.
When bidding, always reply to the highest bidder. If you don't, your bid won't be counted.
OTA:
If you buy a design, all of the payment information applies to you.
Any offers that break the "declinable offer" guidelines will be hidden.
If I accept your art offer, you have two months to complete the offer. If you fail to complete the art in time, then the design will be released and you will not be able to reclaim it. Any currency that you offered prior will not be refunded.
Design Information
Purchasing:
I will only hold a design for 24 hours unless asked for a longer hold (up to 72 hours). If you fail to pay within that time frame, the adopt will be released and you can not claim it again.
Refunds for designs will not be given; however, you are allowed to regift, trade or sell* said design.
*You may resell the design to compensate your original purchase, and you may sell for more than the original purchase if there is art attached. (I don't mean scribbles, I mean art. In layman's terms: don't monetize off my design and rip off buyers.)
If you would like to buy the full rights to a design you’ve bought from me, please contact me with a picture of the design and a link to the original sheet it was bought from and I will give you a quote.
Custom Design Guidelines:
You will be given a colored sketch before you pay and will be allowed two changes (either physical traits or colors) overall, any additional changes will be fee’d and added to your quote.
I will almost always refuse over complicated designs. It doesn't hurt to ask about a design, however.
Design Rules:
Once you purchase a design, you can alter it in any way.
You must credit me for the original design and original artwork. (To clarify, you don't have to shout my name every time it's drawn, but if you put it up on your Toyhou.se or something, please give me credit.)
You are allowed to upload my illustration of the design to other accounts (again, as long as I am credited.)
Commission Information
General:
I reserve the right to decline service at any time. If payment has been received before the work is started, you will receive a full refund.
If you do not wish for your art to be posted, please tell me when you commission me.
If you do not want me to post your commission online or stream the commission process, you must tell me BEFORE I start the commission.
You may repost the art to other sites as long as I am credited.
Commissioned art can not be used for commercial purposes.
General Workflow:
Once your commission or custom request has been received, I will begin work on a sketch with color to show you the composition.
If you’re satisfied with your commission as is, I’ll send an invoice to you that must be paid before I begin to work on it again.
If you’d like something changed that was in your original description, I’ll change it for you for free.
If you’d like something changed that wasn’t in your original description, the change will be fee’d.
All commissioned work will be updated on my Trello To-Do list.
Refund Policy
Commissions:
Commissions that haven’t been started at can be fully refunded (unless stated otherwise.)
Commissions that have been worked on but are not finished are eligible for a refund based on the percentage done.
Here’s a basic list of percentages that can be refunded (can be subject to change):
Sketch: 80%
Sketch & Color: 65%
Line: 50%
Line & Flat Color: 0% (Unless shading was included in the commission, then 15%)
Finished commissions can not be refunded.
Ready-Made Designs:
Ready-Made designs are not eligible for refunds.
Custom Designs:
Custom designs that haven’t been started at can be fully refunded (unless stated otherwise.)
Once the design has been started, you are eligible for a refund based on the percentage done. That being said, if you ask for a refund, you will not receive the design.
Basic list of percentages that can be refunded:
Sketch: 80%
Sketch & Color: 65%
Line: 50%
Line and Flat Color: 0% (Unless shading was included in the commission, then 15%)
Finished customs can not be refunded.
To clarify: If you are refunded, you will receive nothing as you’ll be paying for the time I spent. I keep the design and art.
Punishments
Minor offenses will work on a three strike basis. After your third strike, you will be blocked and put on a blacklist. This means you will not be able to interact with me or purchase any of my merchandise.
Major offenses will get you blocked and put on the blacklist instantly.
