By requesting a commission, the commissioner is agreeing to the following Terms of Service (TOS):
i. General Terms
Details included in the commission request must be provided in a clear manner, containing as many details as needed to complete the commission correctly.
Rude, violent and/or abusive behaviour will not be tolerated, and the artist retains the right to cancel the commission should it occur.
Commissions will only be agreed if the commissioner follows the rules outlined in the commission information and the TOS, and the artist has the right to cancel or refuse the commission should the terms not be honoured.
ii. Payment
A minimum of 50% of the total to be paid as a non-refundable deposit before work begins. The full total to be paid before delivery of the final image.
The accepted currency is GBP£.
iii. Process
A Work in Progress (WIP) may be requested but the artist is under no obligation to provide one.
WIPs may be provided by the artist to ensure the commission is as requested, or to clarify details.
The timescale of a completed commission will vary dependant on factors such as: priority, health, complexity, personal commitments. This will be discussed once all the commission information has been agreed, and/or will be provided in the commission sheet.
Should any issues arise, the commissioner will be notified ASAP to determine further actions.
A low quality, heavily watermarked image will be provided for thoughts before the final image is made available to the commissioner.
iv. Customer Satisfaction
The artist’s top priority is to make sure customers are happy with the process and the finished product. However, once a commission is completed, only minor changes are allowed to be made, e.g. Marking mistakes, small colouring changes, after effects.
Large changes that require significant work will come with additional charges to accommodate the extra time required.
If the initial reference was vague, minor changes will come with a small fee.
v. Copyright/Usage
The artist retains the rights to the artwork produced, not the commissioner. The artist can use the artwork to: Promote themselves in any way and any place that they choose to, display it anywhere they choose to, share it at any time.
Unless agreed otherwise, the commissioner is allowed to: use the copyrighted material for their personal use only, print and display the artwork, claim the rights of their character (but not the artwork), promote the art with proper credit given.
Unless agreed otherwise, the commissioner is not allowed to: reproduce the copyrighted materials commercially, take credit for the creation of the artwork, remove any watermarks of commission text included in the image, recolour or edit the image in any way, trace or copy the image.
Commercial rights to the artwork are available for purchase at 400% of the original price. This will allow the commissioner to use the image in merchandise, provided the correct credit is applied, even if it is altered in any way.
Private commissions are available upon request, with an additional 50% fee. Should the commissioner cancel the commission, the fee is non-refundable.
vi. Cancellations & Refunds
The artist has the right to cancel and refund the commission at any time for fair reason.
If money has not yet been sent, the commissioner may cancel the commission for any reason.
The deposit and private commission fee are non-refundable unless agreed otherwise, or announced by the artist.
The commissioner has no right to a refund.
If a chargeback is filed, the commissioner will have all rights retracted and the artwork will be sold to new customers. The commissioner may never commission the artist again and other artists will be warned of their behaviour.
Any statement can change if discussed with the artist and a new agreement reached, which will be provided in writing prior to the commission.
