TERMS OF SERVICE [GUIDELINES]:
GENERAL
● NOTE: Applicants are required to read the Terms of Service before submitting an application.
● The objectives of the Terms of Service are to clear up any potential misunderstandings that may arise and are also written as a precaution against potential fraud.
● I, the artist, warrant that the work will be my original work performed to the best of my abilities.
● Please refrain from sending me any "Hello" messages. When it comes to inquiries, I favor conciseness and organization.
● Commission prices are subject to change.
● This is not a case of first-come, first-served. To limit the length of my backlog, I prefer to prioritize commissions that I can accomplish surreptitiously.
● I have the right to refuse or terminate projects and requests according to my discretions and capabilities. Refer to my Do's and Don'ts
● Unless Clients request otherwise before the project starts, the process will likely be publicized on Twitter and/or broadcast on Twitch or YouTube.
● Please monitor my Trello for further information! Therefore, you will know when it is your turn.
● For corporations, agencies, organizations, management, and groups, please contact me for further information and to make arrangements.
TIMELINE & PROCESS
● Please fill out my commission form after reading and comprehending my terms of service. I'll confirm it in Direct Messages until I complete reviewing your submitted form, at which point we may discuss the commission(s) in further detail.
● You will be put on the waiting list after the confirmation of your commission.
● Any work in progress will be delivered as soon as I start your commission.
● Throughout the entirety of the project's duration, updates and idea-sharing will occur. Whenever I have anything to share, I will normally request input. I will inform you if anything causes delays or adjustments in project priorities.
● The time required to complete the commission will vary based on its complexity, the type of commission, and the number of individuals on the waiting list. an approximation; (normal: Less than a week to 2-3 weeks max). A quicker response to my commission updates would accelerate the overall process.
● I will suggest up to three acceptable alterations after the draft/sketch phase. The price of any additional items will be increased. I will proactively solicit input.
● Additional charges may be needed for adjustments that have an effect on the project's progress and schedule.
● A character reference sheet or visible images of the character needed is required. Provide enough references needed for the commission. No character charts or descriptions will be accepted as references. Unless you're commissioning a character design, descriptions are fine but should include at least image references from Google, Pinterest, and so on.
● Models from PonyTown, Picrews, or any other model builder are allowed, granted they are visible and used as references.
● After the confirmation of your sketch, you won’t be allowed to change it drastically.
PAYMENT
● Payments will only be accepted through PayPal.

● Always pay in Swiss Franc! (CHF / ₣)
● You will pay in advance (I give priority to commissioners who are adequately compensated.)
● Your name will be added to the waiting list after the confirmation of your order.
● I shall suspend work in the midst of the project until you have paid the whole amount owed under the terms of the agreement.
● Partial payments are permitted. You must give me a specific date by which the remaining balance will be paid.
● Kindly select "family and friends" as your transaction service if you're willing to pay extra PayPal charges.
● Commercial usage will incur a surcharge. ($20)
● Depending on how close the deadline could be, a surcharge will be added to the price of any expedited orders.
● Complex designs, accessories, etc. Will be up-charged.
● Upon the payment's due date, your commission will be prolonged. You will have twenty-four hours to make the payment. Nonetheless, you have the option to pay on a certain day.
● I will not proceed upon your commission until I have received confirmation of your completed form and payment.
COPYRIGHT
● I retain original copyright and ownership of the Work, which includes but may not be limited to redistributing, reproducing, advertising, and displaying the work on my websites, social media, and portfolios according to my discretion. I have the right to repurpose unused process work for future projects, personal or otherwise.
● Clients are granted exclusive rights for personal use of the Work produced as agreed upon, which must not be transferred to any other parties. Personal use includes:
(ex: Social media profile pictures, signatures, layouts, themes, wallpapers, personal website display, social media posts, physical prints, and products) that is not for sale or distribution to any other party. In other words, the commissioned artwork may not be profited from by the client.
● Every piece of artwork will be watermarked; if you publish it publicly, you must always give credit to me; you may not claim sole ownership of any artwork received.
● Please supply me with the right credit, while publicizing the commissions you obtain; examples may include: Artwork by @smolducko or Cotton Sweets.
● I retain the right to feature commissioned works on my website, social media platforms, and portfolio.
● The customer is not permitted to financially benefit from the commissioned artwork.
● I, the artist, own all copyrights to the commissioned work.
● No Work performed for or made accessible to the Client may be utilized for NFT or blockchain-related activities.
● The customer may not change, edit, or reproduce the commissioned artwork without my permission, since doing so would be a violation of my copyright.
AGREEMENT
● This contract is between me, the Artist, and you, the Client, for services rendered on a project known as the Work.
● By participating on any project, once Work has begun or transactions have been made via PayPal or any other payment method, the Client recognizes the product and deliverables are DIGITAL and there is no physically transported item, other than merchandise, to receive. Chargebacks are prohibited, and the refund procedure specified above shall be adhered to.
● The date for this agreement is the date of the first transaction, or a pledge to pay.
● By placing a commission, you agreed to the Terms of Service and Policy, and any violation gives the artist the right to take action on their behalf.
ART MENTORSHIP
For paid instructing services on art-related matters such as fundamental lessons on how to use art programs, illustrating, basic understanding on the art industry, making or designing a model for vtubing including how to rig it. Contact me through email for further information.
Prices will vary based on the duration of each session.
