Penscraper Art Commission Terms of Service
Acceptance of Terms
By commissioning artwork from Penscraper, you agree to be bound by these Terms of Service. Please read these terms carefully before proceeding with your commission.
Commission Process
a. Requesting a Commission: To initiate a commission, you must contact Penscraper at penscraper5@gmail.com and provide details about the artwork you want to commission, including size, medium, subject matter, and any other relevant specifications.
b. Quotation: Upon receiving your request, Penscraper will provide you with a quotation for the commission, including pricing and estimated completion time.
c. Payment: You must pay Penscraper the agreed-upon deposit before work on the commission will begin. Full payment is required upon completion of the artwork.
d. Artistic Freedom: While Penscraper will make reasonable efforts to accommodate your preferences, you acknowledge that artistic interpretation is subjective, and Penscraper reserves the right to exercise artistic freedom in the creation of the artwork.
Rights and Ownership
a. Copyright: Penscraper retains the copyright to all commissioned artwork, unless otherwise specified and agreed upon in writing.
b. Usage Rights: Upon full payment, you will receive a license to use the commissioned artwork for personal, non-commercial purposes. Any commercial use or reproduction of the artwork must be agreed upon in writing and may require additional fees.
Delivery and Shipping
a. Delivery: Penscraper will deliver the commissioned artwork digitally or physically, as agreed upon. Digital files will be provided in a mutually acceptable format.
b. Shipping: If applicable, shipping costs and delivery times will be discussed and agreed upon before shipping.
Refunds and Cancellations
a. Cancellations: If you wish to cancel a commission before work has begun, you may be eligible for a partial refund of your deposit, subject to Penscraper's discretion.
b. Refunds: No refunds will be issued once work on the commission has commenced.
Revisions
a. Minor Revisions: Penscraper may provide a limited number of minor revisions to the commissioned artwork. Major revisions may require an additional fee.
Privacy
Penscraper will treat all personal information provided by you in accordance with applicable privacy laws. Your information will only be used for the purpose of fulfilling the commission.
Limitation of Liability
Penscraper is not liable for any consequential, indirect, or incidental damages arising from the commission, including but not limited to loss of profits or loss of data.
