You agree to ShaneInvasions' Terms of Service, with respect to the creation of their work. Therefore, in consideration of the preceding discussion and the mutual covenant, both parties agree as follows:
INFORMATION
The artist agrees to create the work in accordance with your specifications. The artist will do the following within the week after receiving the form – including the Agreement and the full payment from you.
1. Maintain strong communication and bond to develop an accomplished piece we equally agree upon.
2. Try to showcase progress as a checkpoint or an update, allowing any adjustments you request the artist to change. The artist will deliver to you, via e-mail (or a downloadable hyperlink), within [4] days after you approve the final design(s), digital files containing the final design(s), in the following format(s): PNG (HIGH RES)
PAYMENT
The artist will send an invoice through FreshBooks with the following week, requiring you to complete the purchase. However, for any circumstance, please give notice to the artist immediately. Once you complete the purchase, the artist will begin working on your piece.
1. The artist must provide a rounded due date for each stage to supply you with progress.
2. The artist only agrees upon payment through FreshBooks (i.e. PayPal, Credit Card). The artist in addition must require your email, therefore, propose an invoice to your electronic mail for settlement.
3. If you obtain cryptocurrency, the artist accepts currencies, however, it is a must to withdraw it through PayPal or Credit Card
LEGAL / LIMITATIONS
The artist can’t guarantee that their work will be completely error-free after completion, therefore you have [4] day mark to update the artist to fix it, otherwise after the [4] day mark, the artist is not liable to fix the error. Or if any error occurs from third-party, the artist is not liable for impairments.
1. The artist enforces every right to discard your order if your idea goes against the law, or the artist is uncomfortable to process it further.
2. You must be 18 + to order pornographic material. If the artist is uncomfortable and is asking for identification, you're accommodated to do so.
CHANGES AND REVISIONS
You agree to provide timely feedback for the artist to understand your concerns, objections, or corrections to the art piece(s). You must agree to provide the artist with your feedback and specify any changes.. However, the artist will not go over major changes (i.e., Changing the background completely to a different scenario), as the artist will rightfully charge you extra.
COPYRIGHT
The artist legally retains copyright for all material created under the agreement. Therefore, can showcase sample works from this project as portfolio piece[s], unless client[s] specified otherwise. The artist retains ownership of all unique artwork/files or parts contained therein, whether preliminary or final.
1. You must continue maintaining the artist's trademark on their publicized pieces and credit the artist for their position. Any remove of the artist’s credit and/or watermark, claiming to be yours, will be involved in the judicial matter.
THIRD-PARTY LINKS
Certain content, products, and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with the artist. The artist is not responsible for examining or evaluating the content or accuracy and do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services with third parties.
The artist is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
CANCELLATION/REFUNDS
Both parties understand that the client or the artist may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory by either party. Upon written cancellation, the artist is responsible for refunds based on the project's stages of completion. Each stage the artist is on will deduct refund payment, to compensate for time and effort. If the artist completed the piece, the client has [7] day window to request a partial refund if still not satisfied. After that, the payment will be non-refundable.
