When a buyer enters into a commission with the artist, they agree by these terms.
Please read this text before contacting the artist for a commission.
1) Commissions are accepted At Will. The artist reserves the right to cancel a commission and issue refunds as seen fit for any uncompleted work.
a) If the artist is unable to finish work due to reasons beyond her control, a refund will be issued for unfinished portions of the work, and any finished portion will be sent to the buyer.
b) Buyers who do not reply to emails or messenger contacts will be considered to have canceled their commission if after one month they do not make any method of contact. Any and all funds paid will not be refunded, and any work finished, if paid for, will be available to the commissioner in digital form upon request if later contact is made. The commission may be resumed at a later date if the reason for lack of contact was beyond the commissioner's control.
c) The artist will drop any commission if she judges it to be causing too much stress to her. Refunds will be issued for work not completed.
2) For commissions paying less than $100, large revisions during sketch, ink or color phase will be limited to no more than 1. If the commissioner desires further revisions, it will require an addition to the commission's cost, at the artist's discretion. Complete re-sketches are not included in the large revisions. The commissioner will be informed of these fees.
3) Once the sketch has been approved, the sketch will not be re-sketched or altered. If after the sketch has been approved and the work has moved on to ink or color phase, if the buyer changes their mind and wants a major revision, they will have to enter into a new commission with the artist and all work done on the previous commission must be paid for.
4) The buyer understands that they are paying not only for the artwork and the materials used, but also for the artist's time spent working.
5) Any specific reference materials which the buyer desires to be used by the artist must be provided by the buyer. The artist will not, unless being paid extra, go on a scavenger hunt to find the proper reference materials. If no references are given, the artist is given license to depict the described and unreferenced elements however she imagines or desires.
6) The artist will not, under any circumstances, do mature/adult artwork for anyone under the age of 18.
7) Descriptions for the desired artwork must be limited to pertinent details. Please do not muddy or lose the character description with details on personality or character history. If you would like to include such information, please clearly separate it from the physical description.
8) Please be familiar with the artist's art style and drawing preferences before commissioning her. Try to keep the desired results reasonable. The artist has her own style and drawing preferences; do not expect to get work of a caliber beyond what you can find in her gallery, as this is her art style and level of ability at the time.
9) Payment must be made before work begins.
10) Artwork done by the artist is copyright to the artist unless the buyer also purchases the copyright of the image. Commissioned images done after the date of September 13th 2006 may be made available as prints or any other form of merchandise by the artist unless the commissioner purchases the copyright. Commissioned images may not be used for commercial purposes without the handwritten consent of the artist or the copyright of the image being purchased by the commissioner. Commissioners may not sell prints or any other form of merchandise of the commission without purchasing the copyright of the image first.
a) Commissioned images may be used, by the buyer, for personal avatars (such as on forums or live journals), personal (non commercial) website layouts, and other personal, private, non-commercial uses.
b) The price of purchasing the copyright depends upon the intended use and type of piece. Please speak with the artist if interested.
11) Harassment of the artist by the buyer, including but not limited to sexual harassment, use of profanity against her in messages, death threats, or any other potentially violent behaviors towards the artist will result in immediate cancellation of the commission. The buyer agrees that in such a case, they will forfeit all paid funds and future commissions from the buyer will be refused by the artist.
