By commissioning me, PencilPengi, in any way, you agree to the following Terms of Service.
Be respectful and concise. I work on a three-strike policy; each time you are rude or disrespectful to me as the artist and the individual, to any particular race, sex, gender, religion, disability or political standing, you will receive a strike. Three strikes received at any point during the commission process and I will cancel the commission.
Your reference(s) and/or description of your request must be in as much detail as possible. You must communicate clearly and concisely so that the whole process can go smoothly.
All commissions will be paid half upfront, half when completed.
Works In Progress (WIPs) can be provided along the way, but I will watermark all of them.
Depending on the complexity or size of your request, completion can take up to 1.5 months. Other situational factors can include but are not limited to:
Health
Order of Commission (First Come First Serve)
Schooling
Family and Personal Issues
If any event that may delay process occurs you will be notified ASAP.
I will do whatever is needed to make a satisfactory work that fulfills the client's request. But once the work is finished, I will only do a limited number of minor changes for free.
Examples of a minor change would be:
Small adjustments to coloring, fixing minor line mistakes.
Any major changes will require an extra charge. Examples of a major change would be:
Outfit change/addition/reduction, background change, basically any change that would require me to redraw a section or the entire work.
I, the artist, hold every right to the produced work, not the commissioner.
Therefore, I am allowed to use the copyrighted artwork to:
Promote myself with any place and/or site.
Display and/or post it wherever and whenever I like.
The commissioner is allowed to:
Use the copyrighted artwork for personal use only (unless agreed otherwise).
Print the art.
Claim the right of their character(s) but not the copyrighted work itself.
Use the art to promote themselves with proper credit to me, the artist.
Any break in the copyright revokes the commissioner of their rights over the work. Examples of copyright infringement include but are not limited to:
Reproducing the copyrighted artwork for commercial use (making money out of it in any way).
Taking credit for the creation of the artwork.
Removing any watermarks and/or signatures.
Altering any or all of the artwork without my, the artist's, consent.
PURCHASING FOR COMMERCIAL USE
If you wish to use the artwork commercially, you may purchase the commercial rights of the artwork at 300% of the original fee.
With commercial rights you can alter/edit the artwork to your liking. You are allowed to use the artwork commercially and use it in props, merchandise, and to promote your own brand with.
Credit to me, the artist, is still required, even if the image is altered or edited.
Finally, I have the right to cancel and refund the money for your commission at any time.
If you have yet to send money, you can cancel. Otherwise, once you send money, the right to cancel falls to me, the artist, only.
If you file a chargeback against me, your right to the current commission and commissions prior with me will be revoked. I will not accept any commission from you in future, I will notify others of you, and I have the right to file a complaint and reserve the right to any money you have given me.
Any of the above is subject to change in discussion with me, the artist, prior to confirmation.
