This document represents a legally-binding agreement between Mochine-Nyan and a commissioner.
Summary: Both parties are free to do reasonable things, and protected from the other party doing unreasonable things.
Formal propositions:
The commissioner should not re-sell the artwork or use it commercially (unless agreed otherwise, through a copyright fee). Ad-based or subscription-based services and applications count as commercial use; donation-based ones do not. Blogs and other personal websites, ad-based or not, also don't count as commercial use.
The artist keeps the right to copies and reproductions of the finished commissions for personal use or as part of a portfolio or in other media or platforms in which it is presented as an example of the artist's work, with the guarantee that it will be duly credited to the commissioner and/or owners of additional intellectual property to the artist's best effort in a manner consisted with the media or platform in which it is presented (text descriptions, spoken word, alter text, hyperlinks, or other metadata).
Commissioner is free to reproduce the artwork for personal purposes in any way desired.
When reproduced publicly, the artwork may not be presented along with non-artistic expression that can be construed as slander or libel.
The commissioner will not falsely purport ownership of the character or other items commissioned, and will not order a commission that breaks a local or international law or treaty (including relevant copyright provisions), nor use the work in any way that knowingly violates a local or international law.
Changes in the drawing (if necessary) must be requested in the sketch stage.
Significant alterations to the original request may result in extra fees dependent on how much has to be redrawn.
Partial or total refunds will be issued at the artist's discretion only.
The estimated completion date (given after payment) is a sincere approximation, and not a guaranteed deadline.
An extra fee may be charged for abiding by faster completion of the artwork than previously agreed upon.
The reader of this text may be relieved that there is just one more list item, and that the previous items may or may not be regarded by a relevant portion of the population as "utterly boring like all legal agreements".
Paying for this invoice means the commissioner accepts these terms and conditions.
