By Commissioning me, you agree to my Terms of Commissioning (ToC).
ToC 1: Payment, Requesting, & Pricing.
• The full payment must be given before I begin with your Commission.
• You may request up to 3 Commissions at a time.
• All listed prices are for Personal Commissions. Requests for Commercial Usage will have an extra fee, and this is non-negotiable.
• Prices are always finally determined by me, however you may suggest a budget/price for her to consider.
• The price of your Commission depends on how time-consuming and/or difficult your request is. The easier it is, the cheaper the Commission.
• General Pricing is semi-negotiable, however any offers that are 20% less than the Commission's actual value will be denied.
• Any chargebacks done will result in a permanent ban from my services, no refunds, and the re-selling of your Commissioned product.
• The costs listed in A&C are in USD for the convenience of Kellsyy's customers, however all payments made must meet CAD standards. You may convert the prices listed below to see what their CAD values are.
ToC 2: Types of Requests & Deadlines.
• I do not accept R18+, Socially Unacceptable-based (such as Police Brutality, Racism, and Animal Cruelty), and any request that violates A&C's ToS.
• Most Commissions take 1-2 weeks (3-4 if I'm busy).
• If you'd like the Commission to be done earlier, a fee (determined by me) will be added. It will be listed in each Commission slot.
ToC 3: Copyright & Usage.
• Both Personal and Commercial Artworks should be credited. A link to my DeviantArt or a text saying ❝Artwork done by Kellsy. © 2019 by Kells Designs❞ should be clearly seen when you display the Artwork.
• All Personal and Commercial Artworks remain Copyrighted, regardless.
• My watermark (or credits, if text-based) will remain on all Commissioned requests. This is non-negotiable.
• You may not resell, modify, and/or reproduce any of my Commissioned artworks. If you decide to stop using your product, let me know, and it may be re-sold.
• Even though you own most rights to your Commissioned artwork, I reserve the right to display the finished product in/on any location (both in-real-life and online).
ToC 4: Refunds.
• A 100% refund is given if I cancel your Commission.
• A 15% refund is given if I give your Commission beyond the deadline I state.
• If you are not satisfied with your results, a 10% refund is given.
• If you do not reply to a message I send within 14 days, I will consider the request abandoned; no refunds will be given.
• All refunds are non-negotiable.
ToC 5: Miscellaneous.
• If you'd like WIPs of your Graphic/request as I make progress, please tell me. Otherwise, it will not be given.
• Rude behaviour is not tolerated. This includes rushing me for your Commission's completion and shaming/hatred.
• You are not allowed to cancel your Commission once it's been accepted (unless I approve of it).
• When your Commission is finished, you have 2 weeks to claim your product(s). If you do not claim them, your requests will be re-sold (and no refunds will be given).
• I permit 3 minor changes and 1 major change to any final product. If you'd like your Commission to be re-done, you must pay 60% of the Original Commission price. Besides this, if you'd like to request for more minor and/or major changes, $10 USD (per change) must be paid before Kellsyy performs the alterations.
• 4 Commission Slots (in total) will be open at a time. If all 4 slots are full and your Commission is accepted, you will be listed on the Pending List.
• I can only draw text/vectors, if needed. Any Commission request that does not fit my style or requires extensive drawing will be denied.
• If you request for a Personal Usage Commission but would like to make it Commercial after receiving the final product, you can if you get permission from me and pay a Commercial fee! Please message me through DeviantArt or A&C to negotiate Commercial Usage prices.
• No Personal Commissions may be used for Commercial usage.
• If any Copyright Law(s) or my Terms of Commissioning are violated, I may ban you indefinitely from Commissioning me, cancel your request(s), and/or report the matter to A&C (or higher authorities).
